1. ACCEPTANCE OF TERMS
By accessing or using DRIVEN by Sweet Beets — Indie Music Discovery ("DRIVEN," "we," "us," or "our"), located at https://driven-sbimd.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
2. DESCRIPTION OF SERVICE
DRIVEN is a music discovery and artist analytics platform operated by Sweet Beets — Indie Music Discovery. The platform provides:
- Curated indie music playlist management and discovery
- Artist analytics dashboards including Spotify data, social media metrics, and streaming trends
- Playlist placement and rotation tools
- Integration with third-party services including Spotify, Meta (Instagram/Facebook), TikTok, and YouTube
Core services are provided free of charge. Certain premium tools and features may be offered through optional paid subscriptions as described in Section 6.
3. ACCOUNTS & REGISTRATION
You must create an account to use DRIVEN. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate accounts that violate these terms, provide false information, or engage in abusive behavior.
4. USER CONTENT & CONDUCT
You retain ownership of any content you submit to DRIVEN, including artist profiles, biographical information, and uploaded materials. By submitting content, you grant us a non-exclusive, worldwide license to use, display, and distribute that content solely in connection with operating the platform.
You agree not to:
- Upload content you do not have the right to share
- Use the platform for any unlawful purpose
- Attempt to gain unauthorized access to any part of the platform
- Interfere with or disrupt the platform's infrastructure
- Scrape, harvest, or collect data from the platform through automated means
- Impersonate any person or entity
5. THIRD-PARTY INTEGRATIONS
DRIVEN connects to third-party services including Spotify, Meta (Instagram and Facebook), TikTok, and YouTube to provide analytics features. When you authorize a connection:
- You grant DRIVEN permission to access limited data (such as follower counts and engagement metrics) from those platforms on your behalf
- Your use of those platforms remains subject to their respective terms of service
- You may disconnect any third-party service at any time through your analytics dashboard
- We store access tokens securely and use them solely for the features you have authorized
We are not responsible for changes to third-party APIs, outages, or modifications to their terms that may affect DRIVEN's functionality.
6. FREE & PAID SERVICES
DRIVEN's core features — including playlist discovery, artist profiles, and basic analytics — are available at no cost.
Optional premium tools may be offered through paid subscriptions. If you choose to subscribe:
- Pricing and features will be clearly displayed before purchase
- Payments are processed through secure third-party payment providers
- Subscription terms (billing cycle, cancellation policy) will be presented at the time of purchase
- We reserve the right to modify pricing with reasonable notice to existing subscribers
Free tier users will never be charged without explicit opt-in to a paid plan.
7. INTELLECTUAL PROPERTY
The DRIVEN platform, including its design, code, branding, and original content, is owned by Sweet Beets — Indie Music Discovery and protected by applicable intellectual property laws.
Playlist names, curation methodologies, and platform features are proprietary. You may not copy, reproduce, or create derivative works from any part of the platform without our prior written consent.
8. PRIVACY
Your use of DRIVEN is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using DRIVEN, you consent to our data practices as described in that policy.
9. DISCLAIMER OF WARRANTIES
DRIVEN is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or free of harmful components.
Analytics data is sourced from third-party APIs and may be delayed, approximate, or temporarily unavailable. We make no guarantees regarding the accuracy or completeness of third-party data.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Sweet Beets — Indie Music Discovery and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of DRIVEN.
11. MODIFICATIONS
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the platform after changes constitutes acceptance of the revised terms.
For material changes, we will make reasonable efforts to notify registered users via email or platform notification.
12. GOVERNING LAW
These terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
